The Sejm grants approval for the ratification of an international agreement or the renunciation thereof by the President in the form of a statute, if the agreement concerns issues of basic importance, as indicated in art. 89 of the Constitution, especially when such an agreement delegates to "an international organisation or international institution" the competence of "organs of State authority in relation to certain matters" (art. 90). The ratification and renunciation of an international agreement requires prior consent granted by statute if such agreement concerns one of the following issues: peace, alliances, political and military treaties, rights, freedoms and obligations of citizens specified in the Constitution, the Republic of Poland's membership in international organisations, financial responsibilities imposed on the State, matters regulated by statute or those in respect to which the Constitution requires the form of a statute. A statute which grants consent for a ratification of an international agreement concerning the transfer of State competence in certain matters to an international organisation or institution, is passed by the Sejm by a two-thirds majority vote in the presence of at least half of the statutory number of Deputies. A similar rule applies in the case of the Senate. Consent for the ratification of this type of agreement may be also granted by a national referendum, if the Sejm decides so by an absolute majority votes in the presence of at least half of the statutory number of Deputies. |
